Agreement between User and www.graybeardedgreenberet.com

The www.graybeardedgreenberet.com website and the GB2 Network platform at network.graybeardedgreenberet.com (collectively, the “Sites”) are operated by Gray Bearded Green Beret LLC, a subsidiary of High Sierra Consulting, LLC (“Company,” “we,” “us,” or “our”). The Sites are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of the Sites constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

www.graybeardedgreenberet.com is an E-Commerce Site. Graybeardedgreenberet.com provides bushcraft and tactical survival information, gear, and online bookings for events and workshops. The GB2 Network at network.graybeardedgreenberet.com is our online training and membership platform, powered by Uscreen, offering digital courses, instructional video content, and membership access.

We do not ship any gear outside of the United States and/or Canada at this time.

Digital Content, Courses, and the GB2 Network

High Sierra Consulting, LLC, Gray Bearded Green Beret LLC, and Joshua Enyart do not provide any form of certification for any of our digital courses, whether hosted on the GB2 Network (network.graybeardedgreenberet.com) or delivered through any other platform. The information contained in digital media has been made available for informational purposes only.

High Sierra Consulting, LLC, Gray Bearded Green Beret LLC, and Joshua Enyart do not make any representation or warranties with respect to the accuracy, applicability, fitness, or completeness of any content. We do not warrant the performance, effectiveness, or applicability of any sites listed or linked to in any content.

The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay in seeking it because of something you have read or seen on the Sites.

High Sierra Consulting, LLC, Gray Bearded Green Beret LLC, and Joshua Enyart hereby disclaim any and all liability to any party for any direct, indirect, implied, punitive, special, incidental, or other consequential damages arising directly or indirectly from any use of the content, which is provided as is, and without warranties.

Assumption of Risk

Wilderness survival, bushcraft, land navigation, first aid, and related outdoor activities involve inherent risks, including but not limited to cuts and lacerations, burns, fire, exposure to cold, heat, and weather, hypothermia, dehydration, falls, becoming lost, encounters with wildlife, plants, and insects, and serious injury, illness, or death.

All content, courses, books, films, instruction, and information offered through the Sites and the GB2 Network, and all products sold through the Sites (including knives, axes, saws, fire-starting tools, and medical and trauma supplies), are provided for educational and informational purposes. Any practice, use, or application of the skills, techniques, or information you learn from us, and any use of products purchased from us, is done voluntarily and at your own risk. You are solely responsible for evaluating your own physical condition, abilities, and environment; for obtaining appropriate hands-on training, supervision, and medical advice; for using proper safety and protective equipment; and for complying with all applicable laws, regulations, and land-use rules, including fire restrictions.

To the maximum extent permitted by applicable law, you knowingly and voluntarily assume all risks of injury, illness, death, and property damage arising from your practice or use of any such skills, techniques, information, or products, and you release High Sierra Consulting, LLC, Gray Bearded Green Beret LLC, Joshua Enyart, and their instructors, officers, employees, and agents from any and all claims arising from that practice or use.

Participation in any in-person course, workshop, or event also requires a separate signed liability waiver and release. This section is in addition to, and does not replace, that waiver.

GB2 Network Memberships and Subscriptions

The GB2 Network, hosted at network.graybeardedgreenberet.com and powered by Uscreen, offers subscription-based access to digital courses, instructional videos, and exclusive content. By subscribing to the GB2 Network, you agree to the following terms:

Monthly subscriptions can be cancelled at any time, but there are no refunds for the current billing period you have already paid for. Once cancelled, you will retain access until the end of your current billing cycle. Annual subscriptions are non-refundable after 14 days from the date of purchase. Due to the nature of digital content, we do not offer refunds on any individual course purchases or one-time digital product purchases made through the GB2 Network.

Your GB2 Network account credentials are for your personal use only. You may not share your login credentials or allow others to access your account. Accounts found to be sharing access may be terminated without refund.

We reserve the right to modify subscription pricing, content availability, and platform features at any time. Active subscribers will be notified of material changes via email prior to their next billing cycle.

GB2 Founders 100 Lifetime Membership

GB2 Lifetime Founders 100 Memberships, limited to 100 Founding Members, guarantee access to GB2 Membership content for at least 5 years from the date of purchase. GB2 Lifetime Memberships are non-refundable. As our platforms evolve, Founders 100 members may be migrated to new platforms while retaining their access privileges.

Legacy GB2 Memberships

Members who purchased GB2 memberships through our Shopify-based membership system prior to the launch of the GB2 Network will continue to have access to their membership benefits until their membership term expires. GB2 monthly memberships purchased through Shopify can be cancelled at any time, but there are no refunds for the month that you have already paid for. Memberships are pre-paid for the month and once cancelled you will still have access until your membership expires prior to your next payment date. GB2 Lifetime Memberships purchased through Shopify remain non-refundable.

SMS and Email Marketing Communications

By providing your phone number and opting in, you consent to receive recurring automated promotional and transactional text messages from Gray Bearded Green Beret at the phone number you provided. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. You can opt out of SMS messages at any time by replying STOP to any message. Reply HELP for help.

By providing your email address, you consent to receive marketing emails and newsletters from Gray Bearded Green Beret. You may unsubscribe at any time by clicking the “unsubscribe” link in any email.

Shipping Insurance

Orders over $200 may be subject to signature required deliveries based on risk management practices. Please request in the order notes if you do not want a signature required delivery, but please note that you will be responsible for the order if it shows as delivered but you did not receive it.

Electronic Communications

Visiting the Sites or sending emails to Gray Bearded Green Beret constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email and on the Sites, satisfy any legal requirement that such communications be in writing.

Your Account

If you use the Sites, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Gray Bearded Green Beret is not responsible for third party access to your account that results from theft or misappropriation of your account. Gray Bearded Green Beret and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

If you create an account or place an order using false information, such as a false address, phone number, email, or name, your account can be terminated, or your order put on hold (suspended) until we receive the correct information. This includes purchases for online streaming only. Refunds are not available for purchases that are made under accounts made with false information.

Please note that any purchases or accounts made from countries that are on the United States list of banned countries to do business with will be canceled immediately without refund.

Children Under Thirteen

Gray Bearded Green Beret does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use the Sites only with permission of a parent or guardian.

Cancellation/Refund Policy – Merchandise

Please note we do not accept retroactive discounts. If you forget to enter your coupon code, we cannot apply that discount after the fact.

Gray Bearded Green Beret has a return policy of 30 days after you receive your order. All returned products must be in their original and unused condition and must be in their original packaging. Perishable products and apparel are not eligible for refunds, returns, or exchanges. We also do not accept returns for the following items: clothing of any sort, boots, gloves, batteries, headwear, body armor, first aid or trauma treatment products (including tourniquets), any special order or seasonal items.

There will be a 20% restocking fee for items returned with no defect, which will be deducted from your refund. Please include the original packing slip with all returns for proof of purchase. We do not refund shipping charges, and shipping costs for all returns are the customer’s responsibility if there is no manufacturer’s defect. If your merchandise is found to have a legitimate manufacturer’s defect, your shipping costs will be refunded (lowest rate ground shipping only), or applied towards your exchange, and there will be no restocking fee.

We do not accept returns for any products 30 days after you receive your order. If you would like assistance in returning an item, please contact our sales department via email at info@graybeardedgreenberet.com. We will be happy to walk you through the return process.

Clearance items are not eligible for return. Sale items that are returned will only be returned for the original sale price that you paid, plus the standard 20% restocking fee if a restocking fee applies to your return.

Digital Content Return Policy

Due to the nature of digital products, we do not offer returns or refunds on any online digital product, including courses, memberships, and downloadable content purchased through the Sites or the GB2 Network. By purchasing digital content, you acknowledge that you are receiving immediate access to digital materials and waive any right to a refund.

Lost or Stolen Packages

Gray Bearded Green Beret is not responsible for stolen packages. If packages are shown as “Delivered” and list a date and time that they were delivered, you are responsible for the safety of that package once it has been properly delivered to the address listed on your order.

Tips for avoiding package theft: have your package delivered to your work; have your package delivered to the home of a relative or friend that you know will be home; have your package held at your local post office for pickup; request that your package has signature confirmation upon delivery in your order notes; ask your carrier to place package in an area out of plain view; use a doorbell camera or security camera; be sure to check your tracking updates so you are aware of when your package is going to be delivered.

Lost packages will be reported to the shipping carrier by the customer and a claim filed. At the conclusion of the carrier investigation, a decision will be made on how to proceed. If your package was lost by the shipping carrier, we may replace your gear once an official determination is made by the carrier that your package was indeed lost.

Event / Workshop Cancellation Policy

No refunds are available if you cancel within 60 days of the event date. Your tuition can be applied to a future class if you need to postpone 30–60 days prior to the event date. There are no refunds or postponements inside of 30 days from the event date.

If an event is cancelled by Gray Bearded Green Beret, you will receive a full refund or have the option of attending the next event rather than a refund. A 75% refund of tuition is available if you cancel between 60–90 days prior to the event. If you cancel with more than 90 days before the event date, you will be eligible for a tuition refund, minus a 10% cancellation fee.

If you purchased an event prior to a sale, or did not realize there was a sale, we do not offer retroactive discounts for courses, so we will be unable to provide you a refund for the difference. You may not cancel your event and re-sign up to receive a new discount code either.

If you received any free gear or virtual training as part of any promotions at the time of your course signup, and you cancel within an eligible refund period, your refund will not include the price of the gear or virtual training items you received. The retail value of the free items you received will be deducted from your refund.

In-Person Event Conduct

Students who are not actively participating in any of the GB2 courses, or not following instructions, will not be allowed to stay at the course, and will not be entitled to a refund of any kind. GB2 instructor cadre may dismiss any student for inactivity, or misconduct, at the sole discretion of the lead instructor.

Package Deals & Group Discounts

Package deals and group discounts are 100% non-refundable, at any time.

Act of God Clause

If an Act of God causes the cancellation and rescheduling of an event, such as an earthquake, flood, lightning storm, hurricane, tornado, mudslide, or another natural disaster, the course will be rescheduled within 60–90 days of the original course date. If Gray Bearded Green Beret cannot reschedule the event within that time frame, attendees will be given a voucher to attend any course of their choosing within the next 12 months.

If an attendee misses the course due to the inability to travel from their location due to an act of God, they will be given a voucher for a future course. If there is not a future course scheduled within 12 months, the attendee’s voucher will still be valid until such time that Gray Bearded Green Beret holds another similar event.

Live course cancellations may be made in writing to info@graybeardedgreenberet.com. Cancellations are subject to cancellation fees. For cancellations, amounts paid, minus cancellation fees and other amounts owed, will be promptly refunded. The cancellation fees will be assessed regardless of resale of workshop spot. No refunds will be made in the event of interruption or cancellation by the guest after workshop/class commencement date or for any purchase of a private training. All appropriate refunds will be made directly to the guest’s credit card account.

Pre-orders

All items that are listed as pre-orders are charged at the time of checkout.

Links to Third Party Sites / Third Party Services

The Sites may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of Gray Bearded Green Beret and Gray Bearded Green Beret is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Gray Bearded Green Beret is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Gray Bearded Green Beret of the site or any association with its operators.

Certain services made available via the Sites are delivered by third party sites and organizations, including but not limited to Uscreen (which powers the GB2 Network). By using any product, service, or functionality originating from the Sites, you hereby acknowledge and consent that Gray Bearded Green Beret may share such information and data with any third party with whom Gray Bearded Green Beret has a contractual relationship to provide the requested product, service, or functionality on behalf of users and customers.

No Unlawful or Prohibited Use / Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Sites strictly in accordance with these Terms. As a condition of your use of the Sites, you warrant to Gray Bearded Green Beret that you will not use the Sites for any purpose that is unlawful or prohibited by these Terms. You may not use the Sites in any manner which could damage, disable, overburden, or impair the Sites or interfere with any other party’s use and enjoyment of the Sites.

All content included as part of the service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Sites, is the property of Gray Bearded Green Beret or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Sites. Gray Bearded Green Beret content is not for resale. Your use of the Sites does not entitle you to make any unauthorized use of any protected content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Gray Bearded Green Beret and the copyright owner.

By law, you are not allowed to share or distribute digital content you purchase in any way. Backing up content to your other devices is acceptable (personal use), but anything beyond that is considered theft.

Use of Communication Services

The Sites may contain forums, communities, comment sections, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”). You agree to use the Communication Services only to post, send, and receive messages and material that are proper and related to the particular Communication Service. You agree not to defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others; publish inappropriate, profane, defamatory, or obscene material; upload files that contain viruses or corrupted files; advertise or offer to sell goods or services for any unauthorized business purpose; or violate any applicable laws or regulations.

Gray Bearded Green Beret reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Gray Bearded Green Beret reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason.

International Users

The service is controlled, operated, and administered by Gray Bearded Green Beret from our offices within the USA. If you access the service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the content accessed through the Sites in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.

Indemnification

You agree to indemnify, defend, and hold harmless High Sierra Consulting, LLC, Gray Bearded Green Beret LLC, Joshua Enyart, and their instructors, officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Sites or services, your practice or use of any skills, techniques, information, or products obtained from us, any user postings made by you, your violation of any terms of this Agreement, or your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. Gray Bearded Green Beret reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Gray Bearded Green Beret in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties. The arbitration shall take place in the state whose laws govern these Terms, as set out in the Governing Law section below, unless the parties agree in writing to a different location. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees.

Class Action Waiver

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, AND/OR REPRESENTATIVE PROCEEDING. Further, unless both you and Gray Bearded Green Beret agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer

As used in this section, “GRAY BEARDED GREEN BERET” includes High Sierra Consulting, LLC, Gray Bearded Green Beret LLC, Joshua Enyart, and their instructors, officers, employees, and agents.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITES MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. GRAY BEARDED GREEN BERET AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITES AT ANY TIME.

GRAY BEARDED GREEN BERET AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS CONTAINED ON THE SITES FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. GRAY BEARDED GREEN BERET AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GRAY BEARDED GREEN BERET AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR PERSONAL INJURY, LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITES, OR WITH THE PRACTICE OR USE OF ANY SKILLS, TECHNIQUES, INFORMATION, OR PRODUCTS OBTAINED THROUGH THE SITES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF GRAY BEARDED GREEN BERET OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

Termination / Access Restriction

Gray Bearded Green Beret reserves the right, in its sole discretion, to terminate your access to the Sites and the related services or any portion thereof at any time, without notice. Use of the Sites is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Gray Bearded Green Beret as a result of this agreement or use of the Sites.

Changes to Terms

Gray Bearded Green Beret reserves the right, in its sole discretion, to change the Terms under which the Sites are offered. The most current version of the Terms will supersede all previous versions. Gray Bearded Green Beret encourages you to periodically review the Terms to stay informed of our updates.

Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of New York without regard to the conflicts of laws and principles thereof. Any claim that is not subject to arbitration under these Terms, and any action to confirm or enforce an arbitration award, shall be brought exclusively in the state or federal courts located in the State of New York, and you consent to the jurisdiction and venue of those courts.
